Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website indoorbirdies.com, the online booking system, and the services provided by Indoor Birdies LLC (“Indoor Birdies,” “we,” “us,” or “our”). By creating an account, purchasing a membership, booking a session, or entering our facility, you agree to these Terms.

1. Membership Eligibility

Indoor Birdies is a membership-only facility.

  • Memberships are available only to adults (18+).

  • Minors may attend the facility only when accompanied by an adult member.

  • Minors may not hold memberships independently.

  • The adult member is fully responsible for the conduct, supervision, and safety of any minor in their party.

2. Membership Terms & Billing

  • Memberships are monthly recurring and auto-renew by default.

  • A minimum commitment of two (2) months applies to all memberships.

  • After the minimum period, members may cancel their membership through their account.

  • There is currently no cancellation window requirement, but cancellation prevents future billing only; previously billed amounts are not refunded.

Indoor Birdies reserves the right to modify membership pricing or benefits with reasonable notice.

3. Refunds & Credits

  • Refunds are generally not provided in cash or to the original payment method.

  • At our discretion, refunds may be issued in the form of credit hours for future use.

  • Credit hours have no cash value and are non-transferable.

4. Booking Rules

  • Members may have a maximum of three (3) open bookings at any time.

  • Booking availability is subject to demand and facility capacity.

  • Cancellations made within 24 hours of a booking time require contacting us directly at hello@indoorbirdies.com.

  • Failure to follow cancellation procedures may result in loss of booking, credit hours, or other penalties.

5. Guest Policy

  • Members may bring:

    • Up to three (3) additional golfers

    • Up to four (4) non-golfing guests

  • A maximum of eight (8) total people may be present, with no more than four (4) actively golfing.

  • The member is fully responsible for:

    • Guest behavior

    • Guest safety

    • Any damage caused by guests

    • Compliance with facility rules

Indoor Birdies reserves the right to deny access to guests at any time.

6. Facility Rules & Conduct

All members and guests must:

  • Follow posted safety rules and staff instructions

  • Use equipment properly and responsibly

  • Behave in a respectful and safe manner

Indoor Birdies may suspend or terminate memberships, deny entry, or remove individuals for:

  • Safety violations

  • Damage to equipment or property

  • Abuse of staff or guests

  • Violation of these Terms or facility rules

7. Equipment Responsibility

Members are financially responsible for:

  • Any damage caused by themselves, their guests, or accompanying minors

  • Repair or replacement costs resulting from misuse or negligence

8. Assumption of Risk & Liability Waiver

Golf activities involve inherent risks, including but not limited to:

  • Swinging clubs

  • Struck balls

  • Simulator equipment

  • Slips, trips, or falls

By creating an account and using Indoor Birdies’ services, you acknowledge and agree that:

  • You assume all risks associated with participation

  • You have agreed to a liability waiver during account creation

  • You accept responsibility for yourself, your guests, and any accompanying minors

9. Account Responsibility

Members are responsible for:

  • Maintaining accurate account information

  • Keeping login credentials secure

  • All activity conducted through their account

Indoor Birdies is not responsible for unauthorized use resulting from member negligence.

10. Intellectual Property

All content on indoorbirdies.com, including logos, text, images, and software, is the property of Indoor Birdies LLC and may not be used without written permission.

11. Privacy

Your use of our services is also governed by our Privacy Policy, which explains how we collect and use personal information. By using our website or services, you agree to that policy.

12. Limitation of Liability

To the fullest extent permitted by law, Indoor Birdies LLC shall not be liable for:

  • Personal injury

  • Property damage

  • Loss of data

  • Lost or stolen personal items

This includes claims arising from participation in activities, facility use, or guest conduct.

13. Governing Law & Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any legal action arising from these Terms shall be brought in a court of competent jurisdiction in Florida.

14. Changes to These Terms

We may update these Terms at any time. Updates will be posted on our website with a revised “Last Updated” date. Continued use of our services constitutes acceptance of the updated Terms.
